Terms of sale

GENERAL TERMS AND CONDITIONS OF SALE

Last updated: October 2026

These General Terms and Conditions of Sale (“Terms of Sale”) govern all purchases of products made through vesperlabel.com.

They apply between Vesper Label, as the seller, and any customer purchasing products through the website.

By placing an order, the customer confirms that they have read and accepted these Terms of Sale together with the applicable Return & Refund Policy, Shipping Policy, Privacy Policy and Legal Notice.

Nothing in these Terms of Sale limits any mandatory consumer rights that cannot legally be excluded or restricted.

1. SELLER

The products available through vesperlabel.com are sold under the trading name:

Vesper Label

Legal operator:

Full legal name: Confidential

Legal status: Company

Registered address:
07300 Tournon
France

Email: labelvesper@gmail.com

Website: vesperlabel.com

2. SCOPE

These Terms of Sale apply to consumer purchases of clothing, fashion accessories and other products offered through vesperlabel.com.

They govern, in particular:

  • product information;

  • prices;

  • ordering;

  • payment;

  • delivery;

  • returns;

  • withdrawal rights;

  • legal guarantees;

  • complaints; and

  • dispute resolution.

For matters not specifically addressed here, the other Vesper Label policies referred to in these Terms may apply.

3. CUSTOMER

A customer placing an order must have the legal capacity to enter into a contract.

Where required by applicable law, minors may only place orders with the authorisation of a parent or legal guardian.

The customer is responsible for ensuring that information provided during checkout is accurate, complete and current.

4. PRODUCTS

The products offered for sale are those displayed on vesperlabel.com while stocks last.

Each product page aims to provide the essential characteristics of the relevant product, including where applicable:

  • product type;

  • colour;

  • material;

  • size;

  • design;

  • price; and

  • other relevant characteristics.

Customers should review the product description carefully before purchasing.

5. PHOTOGRAPHS AND COLOURS

We make reasonable efforts to present products accurately.

However, photographs and colours displayed on a screen may vary slightly depending on:

  • screen settings;

  • device;

  • lighting;

  • photography conditions; and

  • normal manufacturing variations.

Minor differences that do not constitute a legal lack of conformity will not automatically entitle the customer to treat the product as defective.

Mandatory legal rights remain unaffected.

6. SIZING AND MEASUREMENTS

Any size guides or measurements displayed on the website are intended to assist customers in selecting an appropriate size.

Minor measurement variations may occur due to:

  • fabric characteristics;

  • production methods; and

  • the method used to measure the item.

Customers are encouraged to review the relevant size information before completing a purchase.

7. AVAILABILITY

Products are offered subject to availability.

We may update stock information at any time.

If a product becomes unavailable after an order is placed, Vesper Label may:

  • cancel the affected item;

  • offer an alternative where appropriate; or

  • refund the amount paid for the unavailable item.

No alternative product will be substituted without the customer's agreement where such agreement is legally required.

8. PRICES

Product prices are displayed on the website before checkout.

The applicable price is the price displayed when the customer confirms the order, subject to obvious pricing errors.

Prices may be modified for future orders at any time.

A price change made after a valid order has been concluded will not normally affect that order.

9. TAXES

Where required, applicable taxes will be included in or added to the price in accordance with the information displayed at checkout and applicable law.

For international orders, additional taxes, import duties or customs charges may apply depending on the destination.

Further details are provided in our Shipping Policy.

10. SHIPPING COSTS

Standard shipping is currently offered free of charge worldwide unless otherwise stated at checkout.

If paid shipping options are offered, the applicable shipping costs will be displayed before the customer confirms the order.

11. PROMOTIONAL PRICES AND DISCOUNTS

Promotions, discounts and promotional codes may be subject to specific conditions.

Unless otherwise indicated:

  • promotional codes have no cash value;

  • discounts cannot normally be applied retrospectively;

  • promotional offers may have an expiry date;

  • certain products may be excluded; and

  • multiple promotions may not be combined.

Vesper Label may refuse a promotional code where there are reasonable grounds to believe that it has been obtained or used fraudulently.

12. OBVIOUS PRICING ERRORS

Despite reasonable precautions, an incorrect price may occasionally appear due to technical or human error.

Where the price is obviously incorrect and a reasonable customer could have identified the mistake, Vesper Label may correct the error and, where legally permitted, cancel the affected order before fulfilment.

Any payment collected in relation to a lawfully cancelled order will be refunded.

This provision does not permit Vesper Label to arbitrarily alter the price of a validly concluded order.

13. ORDER PROCESS

The customer selects the desired product or products and adds them to the shopping cart.

Before completing the order, the customer has an opportunity to review:

  • the selected products;

  • quantities;

  • sizes;

  • prices;

  • delivery information; and

  • the total amount payable.

The customer is responsible for correcting any errors before submitting the order.

14. ORDER CONFIRMATION

After an order is submitted, the customer will normally receive an electronic confirmation.

The confirmation will include or refer to relevant information concerning the order.

Customers should retain the confirmation for their records.

15. ACCEPTANCE OF ORDERS

Submitting an order constitutes an offer by the customer to purchase the selected products.

We reserve the right to refuse or cancel an order before fulfilment where a legitimate reason exists, including:

  • product unavailability;

  • obvious pricing error;

  • payment failure;

  • suspected fraud;

  • unauthorised payment;

  • sanctions or legal restrictions;

  • delivery impossibility; or

  • technical error.

We will not refuse an order for an unlawful or discriminatory reason.

Where a paid order is validly cancelled by Vesper Label, the amount collected will be refunded.

16. PAYMENT

The payment methods available to the customer are displayed at checkout.

Payment may be processed by third-party payment providers.

By submitting payment information, the customer confirms that:

  • the information provided is accurate;

  • they are authorised to use the selected payment method; and

  • the transaction is legitimate.

17. PAYMENT SECURITY AND FRAUD CHECKS

Transactions may be subject to reasonable anti-fraud checks.

Where necessary, Vesper Label or its payment provider may request additional information to verify:

  • identity;

  • payment authorisation;

  • billing information; or

  • shipping information.

An order may be temporarily held or cancelled if payment cannot reasonably be verified.

18. CHARGEBACKS AND PAYMENT DISPUTES

Customers retain the right to raise a legitimate payment dispute where legally available.

However, customers must not knowingly submit false or misleading information in order to obtain a refund or chargeback to which they are not entitled.

Where a chargeback or payment dispute is raised, Vesper Label may provide relevant transaction evidence to the payment provider, including:

  • order confirmation;

  • customer communications;

  • delivery tracking;

  • delivery confirmation;

  • return information; and

  • other evidence relevant to the dispute.

19. ORDER CANCELLATION BEFORE PROCESSING

Customers may contact us to request cancellation of an order before it has entered processing or fulfilment.

Requests should be sent as soon as possible to:

labelvesper@gmail.com

Cancellation cannot be guaranteed once fulfilment has started.

Where an order can no longer be stopped, any applicable statutory withdrawal rights remain unaffected.

20. PROCESSING TIME

Orders are typically processed within approximately:

2 to 3 business days.

Processing may take longer during:

  • weekends;

  • public holidays;

  • promotional periods; or

  • unusually high order volumes.

21. DELIVERY

Standard delivery typically takes approximately:

5 to 7 business days after processing.

The typical total estimated timeframe is therefore approximately:

7 to 10 business days from the date of order.

Delivery conditions are further described in our Shipping Policy.

22. DELIVERY DEADLINES

Unless a specific guaranteed date is expressly agreed, delivery estimates remain estimates.

Nevertheless, Vesper Label will comply with all legally binding delivery deadlines applicable to the transaction.

Where applicable law grants the customer remedies because an agreed or statutory delivery deadline has not been respected, those rights remain fully applicable.

23. SHIPPING DESTINATIONS

Vesper Label sells internationally.

Certain destinations or products may nevertheless be unavailable because of:

  • legal restrictions;

  • sanctions;

  • carrier restrictions;

  • customs rules; or

  • logistical limitations.

Where an order cannot legally or reasonably be shipped, it may be cancelled and any amount paid for the affected order refunded.

24. TRACKING

Orders are shipped using a service providing shipment tracking.

Tracking information will normally be communicated following dispatch.

Customers are encouraged to monitor the tracking status of their order.

25. DELIVERY ADDRESS

The customer must provide a complete and accurate delivery address.

The customer should verify all information carefully before submitting the order.

Where delivery difficulties result solely from incorrect information supplied by the customer, reasonable actual additional costs may be charged to the customer where legally permitted.

26. PARCELS MARKED AS DELIVERED

Carrier tracking may be used as evidence when investigating a disputed delivery.

If a parcel is marked as delivered but cannot be located, the customer should promptly contact Vesper Label.

We may:

  • verify the delivery address;

  • review tracking data;

  • contact the carrier;

  • request delivery confirmation;

  • request GPS information;

  • review photographs;

  • review signatures; or

  • consider other relevant evidence.

A carrier status stating “Delivered” does not by itself remove mandatory consumer rights.

Where the evidence establishes valid delivery to the customer, an authorised recipient or a location properly designated by the customer, Vesper Label will not be responsible for subsequent theft, loss or misplacement to the extent permitted by law.

27. TRANSFER OF RISK

Where applicable French or EU consumer law applies, the risk of loss or damage remains with Vesper Label until the customer, or a third party designated by the customer where applicable, takes physical possession of the goods.

Nothing in these Terms transfers this risk earlier than permitted by mandatory law.

28. CUSTOMS AND IMPORT CHARGES

International orders may be subject to:

  • customs duties;

  • import VAT;

  • local taxes;

  • brokerage charges; or

  • similar fees.

Where these amounts are not collected at checkout, the customer may be required to pay them separately.

Vesper Label has no control over charges independently imposed by foreign authorities.

29. RIGHT OF WITHDRAWAL

Where applicable, consumers benefit from a statutory right of withdrawal.

For customers protected by French or EU distance-selling rules, the withdrawal period is generally 14 days from receipt of the goods, subject to legally permitted exceptions.

To exercise the right of withdrawal, the customer must notify Vesper Label of their decision within the applicable period.

Notification may be sent to:

labelvesper@gmail.com

The customer may use any clear and unambiguous statement expressing the decision to withdraw.

Further information is provided in our Return & Refund Policy.

30. RETURN OF GOODS FOLLOWING WITHDRAWAL

After notifying Vesper Label of a valid withdrawal, the customer must return the goods without undue delay and within the period required by applicable law.

Where EU consumer law applies, this is generally no later than 14 days after notifying us of the withdrawal.

The return address will be communicated after the return request is received.

Customers must not send merchandise to an unauthorised return address.

31. RETURN SHIPPING COSTS

Except where the product is defective, incorrect or where Vesper Label is otherwise legally responsible, the direct cost of returning goods following a change of mind is borne by the customer where legally permitted.

Customers are strongly encouraged to use tracked return shipping.

32. CONDITION OF RETURNED GOODS

Customers may inspect products only to the extent reasonably necessary to determine their nature, characteristics, fit and condition.

Where goods are handled beyond what is reasonably necessary and their value is reduced as a result, Vesper Label may reduce the refundable amount to reflect the actual diminished value where permitted by law.

Full details are contained in our Return & Refund Policy.

33. HYGIENE-RELATED EXCEPTIONS

Certain products may be excluded from the statutory right of withdrawal where the legal conditions for a hygiene or health-protection exception are satisfied.

This may include certain sealed products where:

  • the goods were sealed for hygiene or health-protection reasons; and

  • the customer removed the seal after delivery.

Depending on the product, examples may include certain:

  • underwear;

  • lingerie;

  • swimwear;

  • hosiery;

  • pierced jewellery;

  • cosmetics; or

  • other hygiene-sensitive products.

The exception will only be applied where legally permitted.

34. REFUNDS FOLLOWING WITHDRAWAL

Where a valid statutory withdrawal applies, Vesper Label will refund the amounts required by law within the legally applicable period.

Where French or EU consumer law applies, the refund may be withheld until:

  • the returned goods are received; or

  • the customer provides evidence that the goods have been sent,

whichever occurs first, where legally permitted.

The refund will normally be issued using the original payment method unless otherwise agreed.

35. ORIGINAL DELIVERY COST

Where a statutory withdrawal requires reimbursement of the original delivery charge, Vesper Label will refund the cost of the least expensive standard delivery option offered.

Any additional amount paid because the customer selected a more expensive or express delivery option will not be reimbursed unless required by applicable law.

36. SALE AND DISCOUNTED PRODUCTS

A product being discounted, on sale or purchased using a promotional code does not by itself remove a mandatory statutory right of withdrawal.

The same statutory rights apply unless a lawful exception applies.

37. DAMAGED OR INCORRECT PRODUCTS

Customers should inspect their order promptly after receipt.

Where possible, damaged, defective, incorrect or missing products should be reported within 48 hours to assist us in investigating the issue.

Customers may be asked to provide:

  • photographs;

  • packaging;

  • shipping labels;

  • order number; and

  • a description of the issue.

The 48-hour request is intended to facilitate investigation and does not remove statutory rights or legal guarantees that cannot lawfully be restricted.

38. LEGAL GUARANTEE OF CONFORMITY

The statutory return period and the legal guarantee of conformity are separate legal rights.

For consumers protected by French consumer law, Vesper Label is responsible for the statutory guarantee of conformity under Articles L.217-1 and following of the French Consumer Code.

Seller responsible for the legal guarantee:

Vesper Label
07300 Tournon
labelvesper@gmail.com

IMPORTANT INFORMATION REGARDING FRENCH LEGAL GUARANTEES

The consumer benefits from a period of two years from delivery of the goods to invoke the legal guarantee of conformity where a lack of conformity appears.

During this period, the consumer is required to establish the existence of the lack of conformity under the conditions provided by applicable law.

The legal guarantee of conformity may entitle the consumer, depending on the circumstances and applicable statutory conditions, to:

  • repair;

  • replacement;

  • a reduction in price; or

  • termination of the sale and reimbursement.

Repair or replacement must take place without cost to the consumer and within the statutory conditions and deadlines.

Where the conditions provided by law are satisfied, repair may extend the applicable guarantee period and replacement may result in a new guarantee period in accordance with French consumer law.

The consumer also benefits from the statutory warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code.

These statutory rights apply independently from Vesper Label's commercial return policy.

39. HIDDEN DEFECTS

Where French law applies, the customer may also benefit from the statutory warranty against hidden defects provided by Articles 1641 to 1649 of the French Civil Code.

Subject to the statutory requirements, this guarantee may allow the customer to:

  • retain the product and obtain a reduction in price; or

  • return the product and obtain reimbursement.

The applicable statutory limitation periods remain unaffected.

40. PRODUCT CARE

Customers must follow reasonable care instructions provided with the product.

Normal wear and tear or damage caused solely by improper handling is not a product defect.

Examples may include damage caused solely by:

  • washing contrary to care instructions;

  • excessive heat;

  • improper tumble drying;

  • bleaching;

  • misuse;

  • accidental tearing; or

  • improper storage.

This provision does not affect a legal guarantee where the product itself is defective or non-conforming.

41. CUSTOMER SERVICE AND COMPLAINTS

Customers may contact Vesper Label concerning their order at:

labelvesper@gmail.com

Please include the relevant order number whenever possible.

We may request reasonable supporting information necessary to investigate a complaint.

42. FRAUDULENT CLAIMS

Vesper Label may investigate reasonable suspicions of fraud or abuse.

This may include suspected:

  • false non-delivery claims;

  • false defect claims;

  • substituted merchandise;

  • false return parcels;

  • altered evidence; or

  • deliberately damaged products.

Where appropriate and legally permitted, relevant information may be provided to payment providers, carriers or competent authorities.

This provision does not permit us to refuse a legitimate consumer claim merely because an investigation is undertaken.

43. LIABILITY

Vesper Label remains liable where liability cannot lawfully be excluded.

To the extent permitted by law, Vesper Label will not be responsible for loss caused solely by:

  • improper use of the product;

  • inaccurate information supplied by the customer;

  • unauthorised activity occurring after valid delivery and transfer of risk; or

  • circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability for:

  • mandatory consumer rights;

  • fraud;

  • intentional misconduct; or

  • any liability that applicable law prohibits us from excluding.

44. FORCE MAJEURE

Vesper Label will not be responsible for a failure or delay resulting from an event outside our reasonable control where applicable law recognises such an event.

Examples may include:

  • natural disasters;

  • major transport disruption;

  • war;

  • government restrictions;

  • severe weather;

  • major strikes;

  • widespread carrier disruption; or

  • major telecommunications failure.

Mandatory consumer remedies remain applicable where the law provides them despite such circumstances.

45. PERSONAL DATA

Personal information is processed in accordance with our Privacy Policy and applicable data-protection legislation.

Customers should review the Privacy Policy for information concerning:

  • data collected;

  • processing purposes;

  • recipients;

  • retention;

  • cookies;

  • marketing;

  • international transfers; and

  • data-protection rights.

46. INTELLECTUAL PROPERTY

All intellectual-property rights relating to Vesper Label and its website remain protected by applicable law.

Customers may not commercially reproduce or exploit Vesper Label content without the required authorisation.

47. INTERNATIONAL CUSTOMERS

Vesper Label sells to customers worldwide.

These Terms are intended to establish a general contractual framework.

Where mandatory consumer law applicable in the customer's country provides greater protection than a provision of these Terms, the mandatory local rule will prevail to the extent legally required.

48. GOVERNING LAW

These Terms of Sale are governed by French law.

For consumers outside France, this choice of law does not deprive the customer of mandatory consumer protection provided by legislation that cannot lawfully be excluded.

49. AMICABLE RESOLUTION OF DISPUTES

Before commencing formal proceedings, customers are encouraged to contact us in writing at:

labelvesper@gmail.com

We will attempt to resolve legitimate complaints directly.

50. CONSUMER MEDIATION

In accordance with applicable French consumer law, Vesper Label provides eligible consumers with access to a consumer mediation mechanism.

After first submitting a written complaint directly to Vesper Label, the consumer may, where applicable, refer the unresolved dispute to the consumer mediator appointed by Vesper Label.

Designated consumer mediator:

[MEDIATOR NAME]

[POSTAL ADDRESS]

[WEBSITE]

[CONTACT DETAILS]

These details must be completed once Vesper Label has formally joined an approved consumer mediation scheme.

51. COMPETENT COURTS

If an amicable resolution cannot be reached, disputes may be brought before the competent courts in accordance with applicable procedural and consumer-protection law.

Nothing in these Terms imposes exclusive jurisdiction in France where mandatory law grants a consumer the right to bring proceedings elsewhere.

52. SEVERABILITY

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply where legally possible.

The affected provision will be limited or interpreted to the minimum extent required by applicable law.

53. CHANGES TO THESE TERMS

Vesper Label may update these Terms for future orders.

The version generally applicable to an order is the version made available to the customer when the order is placed.

Future changes will not retroactively remove rights arising from existing contracts.

54. CONTRACTUAL DOCUMENTS

These Terms of Sale should be read together with:

  • the product page applicable to the order;

  • the order confirmation;

  • the Return & Refund Policy;

  • the Shipping Policy;

  • the Privacy Policy;

  • the Legal Notice; and

  • any specific promotional conditions applicable to the order.

In the event of an inconsistency, mandatory consumer law will prevail.
