Terms of service
TERMS OF SERVICE
Last updated: October 2026
These Terms of Service govern your access to and use of vesperlabel.com and any purchase made through the Vesper Label online store.
Throughout these Terms, the terms “Vesper Label,” “we,” “us,” and “our” refer to the operator of Vesper Label.
By accessing our website, placing an order, or purchasing a product from us, you agree to these Terms of Service together with our applicable policies, including our Return & Refund Policy and Privacy Policy.
Nothing in these Terms limits any mandatory consumer right that cannot legally be excluded or restricted.
1. SELLER INFORMATION
The Vesper Label online store is operated from France.
Trading name: Vesper Label
Legal name: Vesper Label
Legal status: Company
Registered address: France
Email: labelvesper@gmail.com
Website: vesperlabel.com
Additional legally required information may be provided in our Legal Notice.
2. ELIGIBILITY AND CAPACITY
By placing an order through our website, you confirm that you have the legal capacity to enter into a binding contract or that you are acting with the authorisation of a parent or legal guardian where required by applicable law.
You must provide accurate, complete and current information when placing an order.
You may not use our website or products for any unlawful or fraudulent purpose.
3. PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, photographs, colours, measurements, sizing information and other product information are accurate.
However, the appearance of colours may vary depending on:
-
screen settings;
-
device characteristics;
-
lighting conditions;
-
photography; and
-
manufacturing variations.
Minor variations that do not amount to a lack of conformity under applicable law shall not automatically constitute a defect.
Product measurements may also vary slightly due to the measuring method, fabric characteristics and manufacturing tolerances.
Nothing in this section limits a customer's statutory rights where a product does not conform to its description or applicable legal requirements.
4. PRODUCT AVAILABILITY
All products are subject to availability.
Displaying a product on our website does not guarantee that it will remain available until an order is accepted.
We reserve the right to:
-
discontinue products;
-
limit quantities;
-
update product specifications;
-
correct inventory information; or
-
remove products from sale,
at any time.
If an item becomes unavailable after you place an order and we cannot fulfil the order, we will notify you and refund any amount paid for the unavailable item.
5. PRICES
Prices are displayed in the currency indicated on the website or at checkout.
The final price applicable to your order will be displayed before you confirm payment.
Prices may change at any time before an order is placed.
Once an order has been validly accepted, a later price change will not affect that order except where permitted by law or where an obvious pricing error has occurred.
6. OBVIOUS PRICING AND WEBSITE ERRORS
Despite our efforts, pricing, promotional, technical, typographical or inventory errors may occasionally occur.
If a product is listed at an obviously incorrect price due to an identifiable technical or human error, we reserve the right, to the extent permitted by applicable law, to correct the error.
Where an order affected by an obvious error has not yet been accepted or fulfilled, we may cancel it.
If payment has already been collected for an order that is lawfully cancelled because of such an error, the amount paid will be refunded.
We will not rely on this provision to arbitrarily change the price of a validly concluded order.
7. PROMOTIONS AND DISCOUNT CODES
Discount codes and promotions may be subject to additional conditions communicated at the time of the promotion.
Unless otherwise stated:
-
discount codes cannot be exchanged for cash;
-
discounts cannot normally be applied retrospectively;
-
only one promotional code may be used per order;
-
codes may have an expiry date;
-
codes may be limited to specific products, countries or customers; and
-
promotional offers may not be combined.
We may deactivate or refuse a promotional code where there is reasonable evidence of misuse, technical error, unauthorised distribution or fraud.
Mandatory consumer rights remain unaffected.
8. ORDERS
Submitting an order constitutes an offer to purchase the products in your cart.
Receipt of an automated order confirmation does not necessarily mean that we have finally accepted your order where applicable law permits acceptance to occur later in the fulfilment process.
We may refuse or cancel an order before fulfilment where there is a legitimate reason, including:
-
a product being unavailable;
-
an obvious pricing or description error;
-
payment failure;
-
suspected fraud;
-
suspected unauthorised payment;
-
sanctions or legal restrictions;
-
an incorrect or undeliverable address;
-
unusual ordering activity indicating abuse; or
-
a technical error preventing fulfilment.
We will not cancel or refuse an order for an unlawful or discriminatory reason.
Where we cancel an order after payment has been collected, the corresponding amount will be refunded unless the payment itself is fraudulent or subject to a lawful payment-provider restriction.
9. ORDER LIMITS AND RESELLING
Unless expressly authorised by Vesper Label, products sold through our website are intended primarily for personal use.
We reserve the right to limit quantities or refuse unusually large or repetitive orders where we reasonably believe that:
-
the purchase is intended for unauthorised commercial resale;
-
automated purchasing systems are being used;
-
the transaction is fraudulent; or
-
the ordering behaviour is intended to circumvent purchase limitations.
Any restriction will be applied in accordance with applicable law.
10. PAYMENT
Available payment methods are displayed at checkout.
By providing payment information, you represent that:
-
the information provided is accurate;
-
you are authorised to use the chosen payment method; and
-
sufficient funds or credit are available to complete the transaction.
Payments may be processed by third-party payment providers.
We may perform or permit payment providers to perform reasonable fraud-prevention checks.
An order may be delayed, held or cancelled where a payment cannot be verified or where there are reasonable grounds to suspect fraud.
11. PAYMENT AUTHORISATION AND FRAUD PREVENTION
To protect Vesper Label and its customers, transactions may be subject to automated or manual fraud screening.
Where reasonably necessary, we may request additional information to confirm:
-
the purchaser's identity;
-
the billing information;
-
the shipping information; or
-
authorisation to use the selected payment method.
Failure to provide reasonably requested verification information may result in the order being cancelled.
We may retain information relating to suspected fraudulent transactions where permitted or required by law.
12. CHARGEBACKS AND PAYMENT DISPUTES
Customers should contact us at labelvesper@gmail.com if they believe there is a genuine problem with an order.
Nothing in these Terms prevents a customer from exercising a legitimate right to dispute a transaction through their bank, card issuer or payment provider.
However, knowingly submitting false information to obtain an unjustified chargeback or payment reversal may constitute fraud.
Where a payment dispute is initiated, we may provide the payment provider with relevant evidence concerning the transaction, including where appropriate:
-
order details;
-
delivery tracking;
-
delivery confirmation;
-
customer communications;
-
return records; and
-
payment information available to us.
We reserve the right to contest chargebacks that we reasonably believe to be unfounded.
13. SHIPPING AND DELIVERY
We ship internationally.
Shipping options, estimated delivery times and any applicable shipping charges will be displayed on the website or at checkout where appropriate.
Delivery times are estimates unless we expressly commit to a specific delivery date.
Actual delivery may be affected by circumstances including:
-
customs procedures;
-
carrier delays;
-
severe weather;
-
transportation disruption;
-
public holidays;
-
strikes;
-
incorrect delivery information; or
-
events reasonably outside our control.
Nothing in this section removes any statutory rights relating to delivery deadlines.
Further information may be provided in our Shipping Policy.
14. CUSTOMS, IMPORT DUTIES AND TAXES
International orders may be subject to import duties, customs charges, local taxes, brokerage fees or other government charges imposed by the destination country.
Where such amounts are not collected by Vesper Label at checkout, they may be payable by the recipient directly to the relevant authority, carrier or customs intermediary.
The customer is responsible for complying with the import requirements applicable in the destination country, except where mandatory law provides otherwise.
We do not control charges independently imposed by customs authorities.
Where legally required, we will accurately declare the nature and value of goods shipped internationally.
15. DELIVERY INFORMATION
Customers are responsible for providing complete and accurate delivery information.
Before confirming an order, you should verify:
-
recipient name;
-
street address;
-
apartment or building number;
-
city;
-
postal code;
-
country; and
-
any other information necessary for delivery.
Please contact us immediately if you identify an error.
We cannot guarantee that delivery information can be changed once an order has entered processing or fulfilment.
Additional costs resulting directly from incorrect information supplied by the customer may be charged or deducted where permitted by applicable law.
16. DELIVERY TRACKING
Orders are generally sent using tracked shipping services.
Tracking information provided by a carrier may be used as evidence when investigating delivery issues.
Where a parcel is marked as delivered but the customer reports that it has not been received, we may investigate the claim with the carrier and request relevant evidence.
Our detailed procedure regarding parcels recorded as delivered is contained in our Return & Refund Policy and/or Shipping Policy.
Nothing in these Terms transfers the risk of loss earlier than permitted under mandatory consumer law.
17. RISK AND OWNERSHIP
Risk in products passes to the customer at the time determined by applicable law.
For consumers protected by mandatory EU or French consumer law, nothing in these Terms is intended to transfer the risk of loss before the customer, or a third party designated by the customer where applicable, has taken physical possession of the goods.
Ownership of products may remain with Vesper Label until full payment has been received to the extent permitted by applicable law.
18. RIGHT OF WITHDRAWAL
Where applicable law provides a statutory right of withdrawal, customers may exercise that right in accordance with our Return & Refund Policy.
For customers covered by the applicable EU/French distance-selling rules, the statutory withdrawal period is generally 14 days from receipt of the goods, subject to legally permitted exceptions.
Our Return & Refund Policy forms part of these Terms.
19. RETURNS AND REFUNDS
Returns and refunds are governed by our Return & Refund Policy, which should be read together with these Terms.
Customers requesting a return must follow the return procedure communicated by Vesper Label.
Sending merchandise to an unauthorised address may delay processing of the return.
Nothing in our return procedure restricts any mandatory statutory right.
20. LEGAL GUARANTEES
Consumers may benefit from mandatory legal guarantees under the law applicable to their purchase.
Where French consumer law applies, this includes, where the legal conditions are satisfied:
-
the statutory guarantee of conformity; and
-
the statutory warranty against hidden defects.
These legal protections are separate from the 14-day right of withdrawal.
Nothing in these Terms or in our Return & Refund Policy excludes or reduces any legal guarantee that cannot lawfully be restricted.
21. PRODUCT CARE AND MISUSE
Customers should follow any care instructions provided with or displayed for products.
Vesper Label is not responsible for deterioration resulting solely from improper use or care, including where applicable:
-
failure to follow washing instructions;
-
unsuitable washing temperatures;
-
tumble drying contrary to care instructions;
-
bleaching;
-
improper ironing;
-
exposure to unsuitable chemicals;
-
misuse;
-
accidental damage; or
-
normal wear and tear.
This provision does not apply where the deterioration results from a defect for which Vesper Label is legally responsible.
22. INTELLECTUAL PROPERTY
Unless otherwise stated, the content of vesperlabel.com, including:

-
other original content

Nothing in this clause restricts uses permitted by applicable intellectual-property law.
23. CUSTOMER CONTENT
If you voluntarily provide or submit reviews, photographs, feedback or other content to us, you confirm that you have the right to submit that content.
You must not submit content that:
-
infringes third-party rights;
-
contains unlawful material;
-
contains malicious code;
-
is fraudulent or misleading; or
-
unlawfully discloses another person's personal information.
Any use of customer-generated content by Vesper Label will remain subject to applicable intellectual-property, privacy and consumer-protection law.
24. REVIEWS
Reviews must reflect genuine experiences and must not contain knowingly false, unlawful or fraudulent statements.
We may moderate or remove reviews where legally permitted, including where they contain:
-
spam;
-
unlawful material;
-
personal data;
-
threats;
-
discriminatory content;
-
content unrelated to the product; or
-
demonstrably fraudulent material.
We will not remove a genuine review solely because it is negative.
25. PROHIBITED USES
You must not use the website to:
-
violate applicable law;
-
commit or facilitate fraud;
-
impersonate another person;
-
interfere with website security;
-
introduce malware or malicious code;
-
attempt unauthorised access to systems;
-
scrape or crawl the website in a manner that disrupts its operation;
-
manipulate payment systems;
-
abuse promotional mechanisms;
-
submit fraudulent refund or delivery claims; or
-
interfere with another person's lawful use of the website.
We may restrict access where reasonably necessary to protect the website, other customers or our legitimate interests.
26. WEBSITE AVAILABILITY
We aim to keep the website available and functioning correctly.
However, we do not guarantee uninterrupted or error-free access.
The website may occasionally be unavailable due to:
-
maintenance;
-
technical issues;
-
security updates;
-
hosting problems;
-
third-party service failures; or
-
circumstances outside our reasonable control.
We may modify or discontinue website features where reasonably necessary.
This does not affect contracts that have already been concluded.
27. THIRD-PARTY SERVICES
Our website may rely on or link to third-party services, including:
-
payment providers;
-
shipping carriers;
-
analytics providers;
-
social-media platforms; and
-
technical service providers.
Third-party websites and services may be governed by their own terms and privacy policies.
Except where Vesper Label remains legally responsible, we are not responsible for independent third-party websites that are outside our control.
28. LINKS TO THIRD-PARTY WEBSITES
The website may contain links to third-party websites.
Providing a link does not necessarily mean that we endorse or control the third party.
Customers should independently review the terms and policies of third-party websites before using them.
29. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Vesper Label will not be liable for indirect or consequential losses that were not reasonably foreseeable at the time the contract was concluded.
Where permitted by law, we will not be responsible for losses caused exclusively by:
-
the customer's misuse of a product;
-
incorrect information supplied by the customer;
-
unauthorised third-party activity occurring after lawful delivery;
-
events outside our reasonable control; or
-
the customer's failure to follow reasonable product instructions.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
In particular, nothing in these Terms limits:
-
mandatory consumer rights;
-
liability for fraud;
-
liability arising from intentional misconduct;
-
liability that cannot legally be excluded; or
-
statutory remedies available for defective or non-conforming products.
30. FORCE MAJEURE AND EVENTS OUTSIDE OUR CONTROL
We will not be responsible for delay or failure caused by events outside our reasonable control where applicable law recognises such circumstances.
Such events may include:
-
natural disasters;
-
serious transportation disruption;
-
war;
-
terrorism;
-
widespread telecommunications failure;
-
governmental restrictions;
-
strikes;
-
epidemics or pandemics;
-
major customs disruption; or
-
other exceptional external events.
Where such an event affects an order, we will take reasonable steps to minimise its impact and will comply with any mandatory consumer remedies applicable to the situation.
31. PRIVACY
Personal information is handled in accordance with our Privacy Policy and applicable data-protection law.
Our Privacy Policy explains, among other things:
-
what information we collect;
-
why we collect it;
-
how we use it;
-
which service providers may receive it;
-
how long it may be retained; and
-
what rights customers may have regarding their personal information.
32. SUSPENSION OR TERMINATION OF WEBSITE ACCESS
We may restrict or suspend access to our website where reasonably necessary because of:
-
fraud;
-
security threats;
-
misuse;
-
unlawful conduct;
-
attempts to disrupt the website; or
-
repeated abusive activity.
Any suspension will not remove rights or obligations arising from an order already validly concluded unless applicable law permits otherwise.
33. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect:
-
changes in law;
-
changes to our business;
-
changes to our services;
-
technical developments; or
-
legitimate operational requirements.
The version applicable to an order will normally be the version in effect when the customer places that order.
Material changes will not retroactively remove contractual or statutory rights relating to previously concluded orders.
The current version will be published on vesperlabel.com together with its most recent update date.
34. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law.
The remaining provisions will continue to apply where legally possible.
35. NO WAIVER
If Vesper Label does not immediately enforce a right under these Terms, this does not automatically mean that the right has been waived.
Any waiver must comply with applicable law.
36. ENTIRE AGREEMENT
These Terms, together with the policies expressly incorporated into them, govern purchases made through vesperlabel.com.
They should be read together with, where applicable:
-
our Return & Refund Policy;
-
our Shipping Policy;
-
our Privacy Policy; and
-
our Legal Notice.
Nothing in this provision overrides information or rights that applicable law requires us to provide separately.
37. GOVERNING LAW
These Terms are governed by French law, subject to any mandatory consumer-protection rules applicable to the customer.
If you are a consumer residing outside France, this choice of law does not deprive you of any mandatory protection granted to you by the law that would otherwise apply to your consumer contract.
38. DISPUTES AND JURISDICTION
If you have a complaint, please contact us first at:
We will attempt to resolve legitimate complaints directly.
Nothing in these Terms restricts a consumer's right to bring proceedings before a court having jurisdiction under mandatory applicable law.
We do not impose exclusive French jurisdiction where doing so would unlawfully restrict the rights of consumers residing in another jurisdiction.
39. CONSUMER MEDIATION — FRANCE
In accordance with applicable French consumer law, eligible consumers may have access to a consumer mediation procedure after first attempting to resolve the dispute directly with Vesper Label.
Vesper Label's designated consumer mediator:
Vesper Label
France
These details must be completed once Vesper Label has formally joined an approved consumer mediation scheme.
Consumer mediation does not prevent either party from exercising rights available before the competent courts.
40. INTERNATIONAL CUSTOMERS
Vesper Label accepts orders from customers in multiple countries.
Mandatory consumer laws differ between jurisdictions.
These Terms establish our general contractual rules but do not exclude any consumer protection that applicable law makes mandatory.
Where a mandatory local rule conflicts with a provision of these Terms, that mandatory rule will prevail to the extent of the conflict.
